  • Anticipatory Bail
  • Anticipatory bail is a direction to release a person on bail, issued even before the person is arrested.
    It is only issued by the Sessions Court and High Court.
    This provision allows a person to seek bail in anticipation of an arrest on accusation of having committed a non-bailable offence.

  • Arrest And Remand
  • Arrest
    An arrest is the act of apprehending and taking a person into custody (legal protection or control), usually because the person has been suspected of or observed committing a crime.
    Chapter five of the Code of Criminal Procedure, 1973 deals with the arrest of persons. Section 41 is the main section providing for situations when Police may arrest without warrant.

    Remand
    Remand is the process of detaining a person who has been arrested and charged with an offense until their trial.
    Typically, a suspect will be remanded only if it is likely that he or she could commit a serious crime, interfere with the investigation, or fail to turn up in court.
    In the majority of court cases, the suspect will be outside custody while awaiting trial, often with restrictions such as bail.

  • Bail
  • Bail is a set of pre-trial restrictions that are imposed on a suspect to ensure that they comply with the judicial process.
    Bail is the conditional release of a defendant with the promise to appear in court when required.

  • Cheating
  • Cheating generally describes various actions designed to subvert rules in order to obtain unfair advantages.
    Section 420 in the Indian Penal Code deals with 'Cheating and dishonestly inducing delivery of property'.

  • Cheque Bounce Cases
  • An offence under Section 138 of the Negotiable Instruments Act, 1881 is made out against a person when such person issues a cheque to pay an amount to another person in respect of some debt or liability and fails to honour that cheque.

  • Criminal Appeal, Revisions And Writ Petitions
  • Appeal
    Appeal is a process of re-examination by a higher court of the judgment, or the order or the decision made by a lower court in a suit or in a case.
    Appeal is the right of entering a superior court and invoking its aid and interposition to redress the error of the court below.
    It is a proceeding taken before a superior court for reversing or modifying the decision of an inferior court on ground of error.

    Revision
    Revision is the act of examining again in order to remove any defect or grant relief against irregular or improper exercise or non-exercise of jurisdiction by a lower court.
    Revision is like re-working and re-writing.
    Revision means the action of revising, especially critical or careful examination or perusal with a view to correcting or improving.

    Writ Petition
    In common law, a writ is a formal written order issued by a body with administrative or judicial jurisdiction; in modern usage, this body is generally a court.
    In the Supreme Court, the writ petition can be filed only for the enforcement of the fundamental rights guaranteed in the Constitution and for no other rights.
    In the high court, the writ petition can be filed not only for the enforcement of the fundamental rights guaranteed under the Constitution, but also for any other purpose.

  • An Act to prevent the commission of offences of atrocities against the members of the Scheduled Castes and the Scheduled Tribes, to provide for Special Courts for the trial of such offences and for the relief and rehabilitation of the victims of such offences and for matters connected therewith or incidental thereto.
